In a Cepani arbitration, the parties pay, in the beginning of the procedure and before the nomination of the arbitral tribunal, an advance on arbitration costs. This advance is determined in accordance with the amount in dispute and on the basis of the arbitration scale which is an integral part of the Cepani Rules( annex I).
The amount following the use of the scale is destined to pay the fees and costs of the members of the arbitral tribunal. The above mentioned amount is increased by 10% to cover the administrative costs of Cepani. The whole constitutes the advance on arbitration costs.
At the end of the arbitral procedure, the Secretariat of Cepani, asks to each arbitrator for a statement of his costs and expenses due to the arbitration, along with an estimation of the hours spent on the arbitration. This last request is needed in order to verify that the tasks have equitably been distributed among the members of the arbitral tribunal.
After receiving these statements, the Secretariat deducts the arbitration costs from the amount it has to pay the fees and costs of the arbitrators. The balance obtained is generally allocated in the following way in order to cover the fees (unless exceptional circumstances or unless otherwise agreed by the arbitrators) 40% for the Chairman of the arbitral tribunal and 30% for each of the co-arbitrators. When a sole arbitrator is appointed, he receives the whole of the amount as fees.
The Secretariat then communicates to the arbitral tribunal the summary of the costs and fees of each member and asks them to hand in an account for the amount granted. After having received these accounts, Cepani proceeds to the payment.
